Terms and Conditions for Tree Surgeons Edmonton
These Terms and Conditions set out the basis on which tree surgery services are provided by Tree Surgeons Edmonton. By making a booking, accepting a quotation, or allowing work to begin, the customer agrees to these terms. They are intended to create a clear understanding of the service scope, payment obligations, site responsibilities, and the way in which tree work, clearance, and related operations are carried out. Tree surgery services can involve practical, technical, and potentially hazardous work, so it is important that both parties understand their responsibilities before any work starts.
These terms apply to all domestic and commercial customers unless otherwise agreed in writing. They cover the booking process, estimates and payments, cancellations and rescheduling, liability and insurance matters, waste handling, and the legal framework governing the agreement. Any variation to these terms must be confirmed in writing. If there is any inconsistency between a written quotation and these terms, the written quotation will take priority only where it expressly states that it overrides these conditions.
The services provided may include pruning, crown reductions, removals, stump-related work, hedge maintenance, site clearance, and associated arboricultural tasks. Each job is assessed on its own merits, and the exact service may depend on access, tree condition, weather, ground conditions, equipment requirements, and any legal permissions that may be needed. Customers are responsible for ensuring that the requested work is lawful and that any necessary permissions, consents, or approvals are in place unless agreed otherwise in writing.
Booking Process
A booking is usually made after the customer provides basic information about the site, the trees or vegetation involved, and the type of work required. A quotation may be given following a site visit, photographic review, or other assessment method chosen by Tree Surgeons Edmonton. Quoted prices are based on the information available at the time and may be adjusted if the actual conditions differ materially from those described by the customer or observed during inspection.
Once a quotation is accepted, a date or estimated period for the work will normally be agreed. Acceptance may be verbal, by email, by message, or by any other clear confirmation method. No booking is guaranteed until confirmation has been issued. Variation of Work and Site Conditions

The customer is also responsible for ensuring that all parties with an interest in the property are aware of the planned work and that consent has been obtained where required. If access is not available, or if the work cannot proceed safely due to circumstances outside the contractor’s control, a call-out charge or cancellation fee may apply.
Payments
Unless otherwise agreed in writing, payment is due in accordance with the terms stated on the quotation or invoice. For most jobs, payment is due immediately upon completion, although deposits, staged payments, or advance payment may be required for larger, specialist, or higher-risk works. Accepted payment methods may include bank transfer, card payment, cash, or other methods confirmed in advance. Payment terms are an essential part of the contract, and failure to pay on time may result in additional charges, recovery action, or suspension of further services.
All prices are normally quoted in pounds sterling and, where applicable, may be subject to VAT. Any estimate provided before inspection is indicative only and is not a fixed price unless explicitly stated. Discounts, promotions, or special arrangements apply only where confirmed in writing. If the customer requests changes to the agreed scope, the final invoice may include reasonable charges for additional labour, materials, equipment hire, waste removal, or time spent completing the revised task.
Cancellations and Rescheduling
If the customer wishes to cancel or reschedule a booking, reasonable notice should be given. Where a cancellation occurs after resources have been allocated, staff have been scheduled, equipment has been prepared, or materials have been ordered, a cancellation fee may be charged to recover part of the lost cost. For larger works, deposits may be non-refundable once planning has begun, unless otherwise required by law.
Tree Surgeons Edmonton may also cancel or postpone a booking where weather conditions, safety concerns, illness, access issues, emergency work, or other circumstances beyond reasonable control make it impractical or unsafe to continue. In such cases, the customer will be offered an alternative date where possible. The contractor will not be liable for delay caused by events outside reasonable control, including severe weather, power interruption, road closure, accidents, or third-party interference.
Where work has started and the customer asks for it to stop, the customer must pay for all work completed up to the point of cancellation, together with any non-recoverable costs reasonably incurred. If access is refused on the day of the appointment, or if the site is unsuitable because the customer has not prepared it as agreed, this may be treated as a late cancellation.
Liability
Every reasonable effort is made to carry out tree work with skill, care, and attention to safety. However, tree surgery is inherently risky and may involve falling branches, moving machinery, cutting tools, unstable timber, uneven ground, and changing site conditions. The customer agrees to keep clear of the work area and ensure that children, pets, visitors, and unauthorised persons remain away from the operational zone during the work.
Tree Surgeons Edmonton will not be responsible for loss or damage caused by inaccurate information, undisclosed defects, hidden structural weakness, or circumstances that could not reasonably have been identified before work commenced. The contractor will not accept liability for damage to underground services, drainage, paving, boundary features, or nearby structures where the risk arose from pre-existing conditions or where reasonable precautions were taken but damage still occurred as a normal risk of the task. This does not exclude liability where it cannot legally be excluded, including liability for death or personal injury caused by negligence.
Any claim for damage must be notified as soon as reasonably possible and, in any event, within a reasonable period after completion of the work. The customer must allow an opportunity for inspection and, where appropriate, remedial action before any third party is instructed. The contractor’s total liability arising from a booking, to the extent permitted by law, will usually be limited to the amount paid or payable for the specific service giving rise to the claim. Nothing in these terms limits rights that cannot lawfully be limited under UK law.
Waste Regulations
Tree surgery and arboricultural work can create substantial waste, including branches, trunks, chippings, leaves, roots, stumps, and other green material. Waste arising from the work will be handled in accordance with applicable UK waste laws and duty of care requirements. Material may be removed from site, reused, recycled, or disposed of through licensed and appropriate routes depending on the agreed service and the nature of the waste.
Unless the quotation states otherwise, the customer should assume that waste removal is included only to the extent described in the written scope. If the customer requests that timber, logs, or arisings are retained, this must be agreed in advance because storage space, handling time, and transport arrangements may be affected. The contractor may refuse to leave waste on site where doing so would create a safety risk, obstruct access, breach local restrictions, or conflict with legal disposal requirements.
The customer must not ask for waste to be disposed of unlawfully. Waste must not be burned, tipped, or stored in a manner that would breach environmental, nuisance, or planning rules. Where invasive species, diseased timber, protected materials, or contaminated waste are encountered, special handling may be required and additional charges may apply. The customer acknowledges that compliance with waste law is a legal obligation and agrees to cooperate with any reasonable request connected to lawful transport and disposal.
Customer Responsibilities
The customer is responsible for giving clear instructions, ensuring safe access, and informing Tree Surgeons Edmonton of any special risks or legal issues affecting the work. This includes notifying the contractor of hidden cables, underground structures, unstable surfaces, shared boundaries, or access restrictions. The customer must also ensure that any permissions from landlords, neighbours, managing agents, or other relevant parties are obtained where necessary.
If the work is affected by Tree Preservation Orders, conservation restrictions, planning conditions, wildlife considerations, or other legal controls, the customer must disclose this before the appointment. The contractor may ask for evidence that the relevant consent has been obtained. If work cannot proceed lawfully, the contractor may refuse to carry out the task and may charge for any time or costs already incurred. The customer remains responsible for ensuring that the work requested is permitted under the law.
The customer should also remove or secure items that may be damaged by debris, vibration, or restricted movement around the site. Although reasonable care is taken, the presence of vehicles, ornaments, outdoor furniture, cables, fragile surfaces, and nearby property can increase the risk of incidental damage. The customer is encouraged to point out anything particularly delicate or valuable before work begins.
Complaints and Remedies
If the customer is dissatisfied with any aspect of the service, the issue should be raised promptly so that it can be investigated. Many concerns can be resolved quickly through inspection, clarification, or reasonable remedial work. The contractor should be given a fair opportunity to assess the matter before any independent action is taken. This does not affect any legal right that the customer may have under applicable consumer law.
Where a genuine fault in workmanship is identified, Tree Surgeons Edmonton may, at its discretion and where reasonable, arrange corrective work or a suitable adjustment. However, no remedy will be available where the issue arose from normal tree behaviour, weather events, regrowth, lack of maintenance after completion, or instructions given by the customer against advice. The purpose of any remedy is to address provable service issues, not to guarantee results that depend on natural conditions.
Governing Law
These Terms and Conditions, and any dispute or claim arising from them, are governed by the law of England and Wales. The parties agree that the courts of England and Wales will have exclusive jurisdiction, except where consumer law provides otherwise. If any part of these terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will continue in full force and effect.
The contract formed between the customer and Tree Surgeons Edmonton reflects the agreed scope of work together with these service terms. By proceeding with a booking, the customer confirms that they have read, understood, and accepted the conditions set out above. These terms are intended to provide fairness, clarity, and legal certainty for both sides in relation to professional tree work carried out in a safe and lawful manner.
